Re: 'Do fathers lose out in divorce.'

Asking if fathers lose out in divorce is to miss the more important point. In both the cases oulined the real losers were the children involved. Each writer describes children who lose, for whatever reason, the love and nurture of both their parents. Seeking to generalise from just two opposing cases is futile. The potential for human behaviour to embrace a myriad of factors leading to the eventual break down of a family was one factor that helped create the Children Act 1989. The law rightly places the welfare of the children above the rights and wrongs of the parents. In th emain it is parents of either gender who thwart the Act.

The present court welfare service is currently on the brink of wide ranging reforms. The new organisation to be known as Children and Family Courts Advisory and Support Service (CAFCASS) will commence duties on 1st April 2001. Its historic link with the Probation Service will be severed and a great deal of work has been under way for the past year within the Lord Chancellor's Dept. to ensure that new standards of practice will apply.
